Terms governing use of Vizuem.
These Standard Terms of Service govern access to and use of the Vizuem website, accounts, subscriptions, automated scans, Evidence, reports, exports, and related services.

Agreement and Eligibility
By creating an account, starting a paid subscription, accepting an order form, or using the service, you agree to these Terms. If you use the service for an organization, you represent that you are authorized to bind that organization.
You must be legally capable of entering into a binding agreement and may not use the service where prohibited by applicable law.
An executed order form, written enterprise agreement, or other expressly accepted written terms may supplement or replace portions of these Terms. Where they conflict, the specifically negotiated written terms control.
Service Description
Vizuem provides automated website and supported-asset scanning, customer-visible Evidence, Digital Risk signals, workflow context, reports, exports, and related account features.
Service availability, scan scope, evaluated pages, supported assets, storage, retention, exports, seats, and support vary by plan, account configuration, and written agreement.
We may improve, modify, replace, or discontinue individual features. We will not represent unavailable or unimplemented functionality as part of a purchased service.
Accounts and Access
- Provide accurate account, organization, contact, and billing information.
- Protect account access links, credentials, devices, and authorized-user permissions.
- Use reasonable safeguards to prevent unauthorized access to customer workspaces and exports.
- Promptly notify Technical Support if you believe an account has been compromised.
- Remain responsible for activity performed through your account by authorized users.
Account sharing outside the authorized organization or plan scope is not permitted unless expressly allowed in writing.
Acceptable Use
You may not use the service to:
- Scan, access, test, or submit a target without authorization or another lawful basis.
- Circumvent plan limits, access controls, security controls, rate limits, or usage enforcement.
- Interfere with the service, connected systems, queues, browsers, networks, or other customers.
- Upload malware, harmful code, unlawful material, or content that violates third-party rights.
- Reverse engineer or attempt to extract non-public source code except where applicable law expressly permits it.
- Use the service to facilitate fraud, abuse, harassment, unlawful surveillance, or other illegal activity.
- Misrepresent automated output as a certification, legal conclusion, or guarantee issued by the service provider.
Customer Content and Scan Targets
You retain ownership of the targets, files, configuration, organization information, and other content you submit or make available to the service.
You authorize Vizuem and its subprocessors to process that content as reasonably necessary to provide, secure, support, and improve the purchased service, subject to the Privacy Policy and applicable written data terms.
You are responsible for confirming that you have permission to scan each target and to submit any files, credentials, configuration, or other customer content.
Fees and Subscriptions
Paid plans are billed through Stripe using the price, currency, billing interval, and plan shown during checkout or in an applicable written order.
Monthly and annual subscriptions renew automatically at the end of each billing period unless canceled before renewal. Applicable taxes may be added where required.
You authorize the applicable payment provider to charge the payment method associated with the account for recurring fees, add-ons, taxes, and other amounts accepted during checkout or under a written order.
Monthly allowances do not roll over unless an applicable written agreement expressly states otherwise. Usage above the included plan scope may require an add-on, plan change, or written approval.
Refund eligibility, if any, is determined by applicable checkout disclosures, written order terms, the published refund policy, and applicable law. Failure to use an available subscription does not by itself create a refund entitlement.
Cancellation and Service Changes
Customers with an eligible Stripe-managed subscription may use the billing portal available from account settings to manage billing details and cancellation.
Unless otherwise stated during cancellation or in a written agreement, cancellation takes effect at the end of the current paid billing period. The subscription may remain active through that period, and future renewal charges stop after cancellation becomes effective.
Plan changes, usage limits, feature access, and retention may take effect immediately or at the next billing period as shown in the account or applicable written terms.
Scan Outputs and Limitations
Automated scanning cannot identify every accessibility barrier, implementation issue, broken target, security condition, or legal risk.
- Results depend on the submitted target, configured scope, authentication state, crawler access, supported content types, and conditions present during the scan.
- Blocked, unavailable, deferred, unsupported, or unevaluated content may not appear in scored output.
- Evidence should be reviewed in context by the customer and its technical, content, design, security, procurement, and legal advisors as appropriate.
- Rescans may produce different results as websites, dependencies, standards profiles, rules, browsers, and scan conditions change.
Vizuem does not provide legal representation, legal advice, expert testimony, certification, or a guarantee that a customer satisfies any law, regulation, standard, contract, or organizational requirement.
Ownership and Feedback
As between the parties, customers retain their rights in customer content and customer operational scan data. Vizuem retains its rights in the service, software, interfaces, workflows, rules, scoring methods, documentation, templates, aggregated or anonymized platform intelligence, and related intellectual property.
Subject to account permissions and these Terms, you may use customer-facing reports and exports for your internal business, implementation, procurement, and advisor workflows.
If you provide suggestions or feedback, you permit Vizuem to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
Third-Party Services
The service relies on third-party infrastructure, payment, hosting, authentication, communication, and operational providers. Current subprocessors are identified on the Subprocessors page.
Third-party websites, scan targets, integrations, and services remain subject to their own terms, controls, availability, and practices. Vizuem does not control customer targets or unrelated third-party services.
Disclaimers
To the maximum extent permitted by applicable law, the service and all outputs are provided on an “as available” and informational basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of Liability
To the maximum extent permitted by applicable law, neither party will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, data, or business opportunity, arising from the service or these Terms.
To the maximum extent permitted by applicable law, Vizuem's aggregate liability arising from or related to the service will not exceed the fees paid or payable for the affected service during the twelve months preceding the event giving rise to the claim.
These limitations do not apply where applicable law prohibits them or to liability that cannot lawfully be limited.
Responsibility for Claims
To the extent permitted by law, you are responsible for third-party claims arising from your unlawful use of the service, unauthorized scan targets, customer content that violates third-party rights, or material breach of the acceptable-use requirements.
Any broader indemnification obligation must be stated in an applicable written enterprise agreement or order form.
Suspension and Termination
We may suspend or restrict access when reasonably necessary to address suspected unauthorized use, security risk, material nonpayment, unlawful conduct, infrastructure abuse, or a material breach of these Terms.
Where reasonably practicable, we will provide notice and an opportunity to correct the issue. Immediate action may be taken when needed to protect customers, systems, providers, or third parties.
Upon termination or expiration, access to paid features may end. Data availability and deletion remain subject to the applicable plan, retention settings, Privacy Policy, and written agreement.
General Terms
We may update these Terms to reflect service, operational, legal, or commercial changes. The current version and effective date will be published on this page. Material changes will be communicated through reasonable account, website, or email notice when appropriate.
If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. Neither party may assign these Terms except in connection with a merger, acquisition, reorganization, sale of substantially all relevant assets, or with the other party's consent.
Applicable law governs these Terms without creating rights or obligations that conflict with mandatory law. Any jurisdiction-specific governing-law or venue provision must be stated in the applicable written order or agreement.
These Terms, together with incorporated policies and applicable written orders, form the agreement concerning the service.
